  • If the act is between persons who are not at the time cohabitating as husband and the victim is 14 or 15 and the offender is 4 or more years older than the victim.
  • If the act is between persons who are not at the time cohabitating as husband and the victim is 14 or 15 and the offender is in a position of authority over the victim and uses that authority to coerce the victim to submit.
  • If the act is between persons who are not at the time cohabitating as husband and the victim is 14 or 15 and the offender is related to the victim by affinity to the fourth degree.
  • If the act is between persons who are not at the time cohabitating as husband and the victim is 14 or 15 and the offender is related to the victim by blood.
  • If the act is between persons who are not at the time cohabitating as husband and the victim is 14 or 15 and the offender is a member of the same household as the victim.
  • If the act is between persons who are not at the time cohabitating as husband and the victim is 12 or 13 years of age.
  • If the act is between persons who are not at the time cohabitating as husband and the victim is suffering from a mental defect or incapacity which precludes giving consent.
  • If the act is done by force or against the will of the victim.
